ATV Accidents

The Nevada desert is known for its abundance of outdoor recreational activities and use of All-Terrain Vehicles (ATVs), also known as “quads.” As the use of ATVs or quads have increased, unfortunately so have accidents resulting in serious injury death. Bicycle and Pedestrian Accidents

Dog Bites and Dog Attacks

Ridesharing Accidents

The law relating to insurance coverage for ride-sharing services is relatively new, and oftentimes ride-sharing companies attempt to avoid responsibility by shifting the blame on the driver or not disclosing the full amount of insurance coverage available. As services like Uber and Lyft come to more cities, new laws are being established to protect consumers who are injured while utilizing a ride-sharing service or by a ride-sharing driver.

 

Under Nevada law, those who are injured while passengers in ride-sharing vehicles have a right to compensation that covers medical expenses, pain and suffering, and other out of pocket expenses related to the injury. Where that compensation comes from may be contested depending on how and when the accident occurred. Adding further complication is that personal insurance policies oftentimes exclude coverage for commercial activities.

 

Nevada law currently requires companies such as Uber and Lyft to maintain $1.5 million in liability insurance coverage when a passenger is in a ride-sharing vehicle or the driver is actually on the way to pick up a confirmed passenger. But if there is no passenger in a ride-sharing vehicle or the driver is not on the way to pick up a confirmed passenger, the statutory requirements for liability coverage under Nevada law are much lower.

Uninsured/Underinsured Motorist

Uninsured Motorist (UM) and Underinsured Motorist (UIM) motorist insurance protects the victim in a motor vehicle accident when the at-fault driver does not carry enough insurance or any insurance at all. In Nevada, the minimum liability coverage insurance required is 15/30/10, which means $15,000 bodily injury person, $30,000 bodily injury per accident, and $10,000 property damage. Rarely is the statutory minimum coverage enough to cover a serious accident or injury.

 

UM/UIM insurance is the only way to protect yourself in the event of an accident or injury caused by someone who only has the statutory minimum liability coverage or has not insurance at all. WHAT TO DO IF YOU ARE IN A CAR ACCIDENT:

1. Your first priority is to think about your safety and the safety of those around you. If someone is injured, immediately call 911.

 

2. Stay calm. Being in an auto accident is scary but getting upset will make things worse.

 

3. Gather information.

 

a.  Be respectful, but do not admit fault in the accident.
b.  If you have a smart phone or camera, take as many photos as possible.
c.  Take down the names and auto insurance information of any drivers involved in the accident.  Consider simply taking photos of everyone’s driver license and auto insurance information.
d.  Gather names and contact information for any witnesses to the accident.  Consider simply taking photos of any witness statements and/or their contact information.
e.  Provide your insurance information to law enforcement officers and to other driver(s).

 

4. Complete a SR-1 Traffic Collision Report with the Nevada Department of Motor Vehicles to report a traffic collision if a traffic accident report was not prepared by law enforcement.
